These Terms of Use (“Terms”) govern your access to sealedpeptides.com (the “Site”) and your purchase of products from Sealed Peptides (“we”, “us”). By using the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 21 years old and able to form a binding contract to use the Site or place an order. By ordering you confirm that you meet these requirements.
2. Research use only
All products sold by Sealed Peptides are intended strictly for in vitro laboratory and research purposes. They are not drugs, foods, dietary supplements or cosmetics, are not approved by the FDA or any other regulator for human or veterinary use, and are not intended to diagnose, treat, cure or prevent any disease. They must not be consumed, injected, applied or administered to humans or animals. We do not provide dosing, administration or medical guidance, and nothing on the Site is medical advice.
3. Purchaser responsibilities
By placing an order you represent that you are a qualified researcher or laboratory professional, that you will use the products only for legitimate scientific research, and that you will handle them according to applicable laboratory safety practice. You are solely responsible for ensuring that your purchase, possession and use comply with all federal, state and local laws and institutional policies. You agree not to resell products for human use.
4. Orders and acceptance
You can place an order with an account or as a guest (no account), using a valid email address and shipping address. If you have an account, you are responsible for keeping your password confidential and for activity under it. Guest orders do not earn or use rewards points and are looked up with the order number and email address on the order. We may suspend or close accounts used for fraud or in breach of these Terms. Placing an order is an offer to buy. We may accept, limit or cancel any order at our discretion, including if we suspect a violation of these Terms, a pricing or stock error, or a compliance concern. An order is confirmed when we have received your payment and notified you.
5. Pricing and payment
Prices are in US dollars and may change without notice. We accept credit and debit cards (processed by Square) and Zelle. A card payment is charged when you place the order; if the charge is declined, the order is not placed. For Zelle, we email you an order number and payment instructions; please include the order number in the Zelle memo. Card payments are subject to our Returns Policy (replacement only); where a refund is issued, it goes back to the original card. Orders are prepared and shipped after payment is confirmed. Unpaid orders may be cancelled.
6. Shipping
We ship within the United States by USPS Priority Mail, or by UPS 2nd Day Air or UPS Next Day Air where offered at checkout (UPS delivery times are UPS estimates and are not guaranteed; UPS does not deliver to PO Boxes or APO/FPO/DPO addresses). See our Shipping Policy for rates, free-shipping threshold, handling time and packaging. Risk of loss passes to you when the carrier delivers the package to the address you provided; please give us a complete and accurate address. Orders placed for local pickup (by appointment only, Flint, Michigan area) are not shipped; the pickup address and time are provided only after we confirm the appointment by email.
7. Returns and replacements
Because of the nature of research materials, all sales are final and we do not accept returns or issue refunds. Qualifying orders (damaged, incorrect, defective, or lost in transit and confirmed undeliverable by USPS) are eligible for a replacement as described in our Returns Policy.
8. Product information
We work to keep product information accurate, including specifications, stated purity and storage guidance, but we do not warrant that it is complete or error-free. Research summaries on the Site describe published literature for educational purposes and are not claims of safety or efficacy.
9. Intellectual property
The Site’s content, text, images, logos and design are owned by Sealed Peptides or its licensors and may not be copied or reused without permission, except for personal, non-commercial viewing.
10. Disclaimer of warranties
The Site and products are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, Sealed Peptides will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from misuse of products or use contrary to these Terms. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
12. Indemnification
You agree to indemnify and hold harmless Sealed Peptides from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of any product.
13. Governing law
These Terms are governed by United States federal law and the laws of the state in which Sealed Peptides operates, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in that state.
14. Changes
We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
